You can live out your space pirate dreams in Starfield. When encountering travelers in space, you can choose to demand they hand over their cargo to you. You can also dock and go for a more hands-on approach to stealing from them.
This crime may lead to combat on the spot or possible retaliation in the future.
You will need to smuggle any contraband you have past security ships orbiting major settlements like New Atlantis by equipping special ship parts, as confirmed in the Dev Q&A.
Contraband, specific items which are outlawed and have certain back stories, is illegal everywhere so getting caught handling these may land you in jail or with a bounty on your head.
You can pickpocket or steal from NPCs and enemies using stealth, hiding in the dark, or by crouching behind them. Stealing allows you to get extra items, gear, and Credits but may lead to battles if caught.
How to Steal Without Getting Caught
Starfield has stimulants and chems which you can sell or use for yourself. Be warned that using multiple stimulants can causes you to become addicted and its withdrawal symptoms add debuffs.
Killing NPCs when not required by a mission has different consequences from killing enemies.
This crime may lead you to offending certain factions and having a bounty placed on your head on top of possible jail time.

You can face arrest after committing crimes. However, you can choose if you want to go to jail, pay a fine, or resist arrest.

Bounties have been confirmed in Starfield. If you get a crime bounty placed on your head, you will have to fight mercenaries and bounty hunters that appear at random times.
Crime bounties are placed by factions that you have offended or worked against.
You may get into fights if you are caught committing crimes or if you resist arrests. We recommend holding off on these when low on health, ammo, and the like.
