Unlocking the Idea Tree lets you unlock Buildings and Laws. This includes Prisons. Additionally, to unlock the Idea Tree, you must build a Research Institute first.

Research Watchtowers

Frostpunk 2 Research Watchtowers
Watchtowers should be researched in order to unlock Prisons. They are available in the Idea Tree, which is located at the bottom right of the game. Once inside, go to the Society section and the research idea for watch towers should be there.

Research and Build Prisons

Frostpunk 2 Research and Build Prisons
Once the Watchtowers are unlocked, research the idea for Prisons next to be able to build them after the research is completed.

Expand a Housing District

Expand Your Housing Districts
Buildings in general can't be built until a Housing District is expanded. This includes prisons, which need an expanded housing district to be placed in one of its building slots.

Which Prison to Build

Isolation Prison

Frostpunk 2 Which Prison to Build
Isolation Prisons, which are supported by New Londoners and Frostlanders, are highly recommended as they have the least negative impact. Thought-Correction Prison, supported by Stalwarts, decreases trust, while Punitive Prison, supported by Pilgrims, increases tension.

However, it's important to note that you could still chose to build the other prisons in order to built better relations with the Pilgrims or the Stalwarts.

What are Prisons

Unlocks District Abilities and Space for Detainees

Frostpunk 2 What are Prisons
Prisons provide 500 capacity for detainees, decrease Crime, and unlock District abilities. These District abilities include Conscript Inmates and Mobilise Prison Wardens. Both abilities provide more Guard squads but reduces Prison's effect on crime.
